FINANCIAL MARKETS LAW AND REGULATION (LL.M. & M.A.)

In recent times, global financial markets and its regulations have been subjected to radical changes, mainly attributable to the increasing realization of technological innovation and its impact on the financial sector.

These changes have raised complex issues that reinforce the need to explore more effective and sustainable approaches to regulate global transactions in insolvency, disputes, corporate governance, and anti-money laundering.

For this reason, Financial Markets Law and Regulation as a programme of study has been introduced to equip learners with the ability to approach these emerging issues more ingeniously.

What are the bottom-up concepts of law, Financial Market Law and Regulation trends that must be mastered for innovative participation in the creation of policy and regulatory structures; and the successful implementation of private and public sector financial projects; with contextual local and regional impacts on economic growth?


PROGRAMME OBJECTIVES:

To help answer the need to facilitate economic growth, the University of Ghana School of Law's MA/LL.M. Financial Market Law and Regulation adopts both top-down and bottom-up approaches to train public and private sector leadership and managerial staff with the: objectives to:
1.    Introduce students to various research methods in the social sciences as they relate especially to law or socio-legal studies.
2.    Discuss the planning and pitfalls of research data collection.
3.    Introduce students to the various skills and methods of conducting legal research.
4.    Introduce students to legal academic writing, data collection, and interpretation of the data.
5.    Improve students understating of the various empirical research approaches and strategies of legal research.

 

ENTRY REQUIREMENTS:

  • First Degree from a recognized University.
  • Entry Exam / Interview
  • M.A. - proven interest, exposure or experience in finance (prior knowledge in law not required).
  • LL.M. – prior Bachelor’s Degree in law - LL.B., B.A Law, etc. (prior Financial Markets knowledge is required).

  • GHS 22,355.00 (Ghanaians)
  • USD 9,178.00 (Non-Ghanaians)
  • GHS 2,445.00 (Admission Processing Fees)

 


PROGRAMME STRUCTURE
The two semester programme comprises lectures, seminars, field visits, job fairs and dissertations. There is core, required and elective courses. Continuous assessment shall be the main mode of examination. Students are therefore expected to actively participate in topical seminars and make innovative contributions on legal and non-legal approaches to the regulation of technologies within their own contexts. Research works leading to dissertations and papers are expected to be selected according to student interests and of practical benefit to student-chosen institutions. Industry practitioners shall facilitate seminars and job fairs to increase student exposure to the job market and industry needs.

PROGRAMME CONTENT
The M.A./LL.M. Financial Markets Law and Regulation programme includes the following core courses:

INTRODUCTION TO FINANCIAL MARKETS & EXCHANGES

Origin and development of financial market, markets and exchanges, market operations, market functions, market structure, market trading, market and exchange evolution, regulatory challenges, market orders, evolution of ownership and control, exchange regulations, structure, and operations.

PRINCIPLES OF FINANCIAL MARKETS REGULATION
Principles relating to the regulator, principles for self-regulation, principles for the enforcement of financial markets and securities regulation, principle for cooperation in regulation, principles for collective investment schemes, principles for market intermediaries, principles for secondary markets.

RESEARCH METHODS
Introduction to research methods, introduction to law, legal research writing and research, data Collection and analyses, effective proposal writing, planning your research, ethical issues in research.

FINANCIAL MARKETS LAW AND REGULATION: EMERGING ISSUES
The developments causing changes and changes, the challenges confronting the regulation of financial markets and securities, the regulatory framework for emerging markets and its challenges, discussions on emerging financial markets and securities activities.

ANTI-MONEY LAUNDERING AND RELATED FINANCIAL MARKETS PRACTICES
The concept of money laundering and unsafe and unsound practices in financial markets, the regulatory and supervisory framework for preventing and combating money laundering and unsafe and unsound financial practices, the supervisory authorities and regulated institutions, statutory offenses and penalties for money-laundering and unsafe and unsound financial practices.

FINANCIAL MARKETS REGULATION AND CORPORATE GOVERNANCE
Financial Markets – an introduction, corporate governance techniques, regulatory organizations in the Financial Markets, corporate governance in the Financial Markets, self-regulatory organizations and the securities, ensuring stakeholder engagement, compliance dimensions.
